End User Terms of Use for World Travel, Inc. Products
Introduction
We offer Products to enhance our customers’ travel booking and program management experience. While the heart of our business is booking travel, we recognize that the customer experience is be greatly enhanced by a suite of appropriate products and related services. We have invested significant time and capital into these Products. We are proud of them! There are, however, some rules that come along with using our proprietary Products. We encourage you to read these Terms very carefully, as they will impact your ability to use our Products. As described herein and in the privacy policy, our Products process personal data.
If you use any Product, you are bound by these Terms and the aforementioned privacy policy. Stated another way, the simple act of using a Product means you are bound by these Terms. No other action is necessary. These Terms are a legal binding document. If you disagree with these Terms, or the applicable privacy policy, do not use or continue to use any Product. You may ask to have your account deleted at any time by sending an email to privacy@worldtravelinc.com.

We have included a section of definitions to aid your ability to read and understand these Terms.
These Terms may be amended at any time, in our sole discretion. We may make changes without notice. Any changes to these Terms are effective as of the effective date of such changes.
Definitions
End User means an individual (person) who uses a Product. An Authorized End User is an End User who has express permission to use a Product. Only World Travel, Inc. or its client may grant such express permission. Our Products are intended for our clients’ travelers and other employees and not the public at large.
Personal data means any information relating to an identified or identifiable natural person (a “Data Subject”); one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, or an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. In this policy, the terms personal data and personal information are used interchangeably.
Process is used in its broadest sense to mean any operation or set of operations performed upon data, such as collecting, using, sharing, storing, altering, retrieval and the like.
Products means the software and/or applications listed in Table 1.
Services means the combination of products (e.g., software, applications) and services (e.g., making travel reservations, other travel-related professional services) that we offer to clients, and which are in turn provided to and used by Travelers and End Users.
Traveler means any person who books travel using our Services. Most often, Travelers are one of our client’s employees.
Travel Supplier means an airline, railway, cruise line/ship, hotelier or place of lodging, provider of ground transportation, tour, or other provider of travel service that would be named in a traveler’s itinerary.
You and its derivations means you, an Authorized End User.
1. Permitted Uses
Only Authorized End Users may use a Product.
- Anyone may download any mobile Product from the app store of their choice (e.g., Apple or Android app stores).
- Authorized End Users shall only use a Product so long as our client, usually an End User’s employer, is licensed to have access to and use a Product.
- Products shall only be used for their intended business purposes. Products cannot be used for personal, non-commercial use.
- Authorized End Users are required to create an account. We will validate accounts using information available to us, such as a Travel Profile or by contacting a client to validate an End User’s identity.
- If you are an Authorized End User, you are responsible for maintaining the confidentiality of your account credentials, such as your unique username and password.
- You may ask to have your account deleted. In some cases, your employer (our client) will ask to have your account restricted or deleted.
You may have the opportunity to provide us with comments, feedback or other user-generated content. We do not wish to receive any confidential, secret, or proprietary information or other material from you or derived from you using any Product
2. Prohibited Uses
- Only Authorized End Users may use any Product.
- Sharing account credentials is strictly prohibited.
- You shall not circumvent or disclose user identification or security of any Product.
- You shall not interfere with the operation of any Product.
- You shall not interfere with any other person’s enjoyment of a Product.
- You shall not infringe on any person’s or entity’s intellectual property rights. More about this is set forth below.
- You shall not copy, translate, decompile, reverse-engineer, or otherwise modify any Product. You shall not access any Product with the purpose or intention of copying its features or user interface or working with another to do the same.
- You shall not use any product to transmit any content, data or information that is unlawful, abusive, malicious, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, racially or ethnically objectionable, or otherwise improper in our sole discretion.
- You shall not upload or disseminate any virus, adware, spyware, worms, or other malicious code into any Product.
- You shall not directly or indirectly attempt to actually collect personal data about other End Users.
- You shall not interfere with any of World Travel, Inc.’s networks, equipment, servers or other computing resources that connect to or support any Product.
- You shall not perform any fraudulent activity, such as impersonating another person or entity or claim false affiliations.
- You shall not access any account other than your own, or accounts for which you have been expressly granted “admin” or “super user” rights.
- You shall not use any Product contrary to applicable local, state, federal or other law, rule, or regulation.
You shall not assist any person or entity with any of these prohibited activities.
3. Disclaimer of All Warranties
To the extent permissible by law, each Product is provided to you on an “as is” basis, without warranty of any kind, either expressed or implied, including without limitation, warranties that any Product is free of defects, merchantable, fit for a particular purpose, non-infringing, or any warranty arising from course of performance or usage or trade. The entire risk as to the quality and performance of any Product is with you.
4. Limitation of All Liability
To the extent permissible by law, World Travel, Inc. shall have no liability whatsoever to you or any Authorized End User, except as expressly provided in these Terms.
5. Ownership of Intellectual Property
- The Products, including their design, graphics, text, sounds, pictures, software and other files, the selection and arrangement of such items, and information you contribute to any Product, are the property of World Travel, Inc. and/or its licensors.
- The Products are protected by U.S. and international copyright and other intellectual property laws and rights.
- Any and all trademarks, service marks, trade names, trade dress, and logos (collectively, “Marks”) contained or described in a Product are the sole property of World Travel, Inc. and/or its licensors.
- All rights to the Products in their entirety not expressly granted in these Terms are reserved for their respective copyright or other intellectual property owners. You do not acquire any such rights by using any Product.
- You must keep these intellectual property rights intact. You shall not create any derivate work. You shall not copy, reproduce, distribute, republish, download, perform, display, post, transmit, exploit, create derivative works or otherwise use any Product or any part of any Product, in any form or by any means, without the prior written authorization of World Travel, Inc. or the respective owner of such intellectual property rights.
- World Travel, Inc. reserves the right to enforce its intellectual property rights to the fullest extent allowable by law.
- You have a non-exclusive, non-transferrable, revocable and non-sublicensable right to use and access our Products.
6. Other Important Information
- Our Products process data, including personal data, in accordance with the privacy policy you can find here: https://www.worldtravelinc.com/privacypolicy/productsandservices.
- We may change a Product’s function or feature(s) at any time, in our sole discretion. We may remove a Product from use (production) at any time in our sole discretion.
- We may suspend or revoke your account at any time, in our sole discretion.
- This policy will be enforced by the Chief Information Officer, in consultation with corporate counsel and the Director, Information Security and the Director, Product Management. We have mechanisms in place to audit our own compliance with this policy.
- None of our services are directed towards children and we do not knowingly solicit children or collect data from children under the age of 13. We however recognize that certain clients (sports leagues, educational institutions) may ask us to book travel for individuals who are under the age of 18. If such circumstances arise, we require a parent or guardian to make reservations on the minor’s behalf. We will take all reasonable measures to delete or promptly de-identify any data we collect from any individual under the age of 18.
- We will not discriminate against any individual who enforces their rights under this policy or pursuant to any applicable law, rule, or regulation.
- We will reply to any inquiry submitted to privacy@worldtravelinc.com within 45 days. We reserve the right to extend that deadline by an additional 45 days, if we also provide notice to the sender that the deadline has been extended.
- The laws of the Commonwealth of Pennsylvania shall apply to these Terms. You agree that any dispute that arises from or relates to any Product and/or these Terms shall be brought before the state and federal courts located in Chester County, Pennsylvania.
- YOU AND WORLD TRAVEL, INC. EACH AGREE TO WAIVE YOUR RIGHTS TO A JURY TRIAL.
